“If the government becomes a law breaker, it breeds contempt for law; it invites every man to become a law unto himself; it invites anarchy. To declare that in the administration of the criminal law the end justifies the means ‘to declare that the government may commit crimes in order to secure the conviction of a private criminal’ would bring terrible retribution.” Associate Justice of the Supreme Court of the United States Louis D. Brandeis (1856-1941)
RightABigWrong.Org’s civil rights initiative, Every Violation Admonished [“EVA”], deals with a social issue that is taboo in American society: Organized Judicial Misconduct. Among the most consequential routine of this Organized Judicial Misconduct occur in state Family Court. It is described under the main menu button labeled “Unlawful Government Intrusion and Fees.” [Also see sections in the drop down menus titled “Judicial Misconduct“ and “Judicial Regulation.”]
There are many reasons why discussions of Organized Judicial Misconduct are restricted by social custom. Among them is a lack of awareness that is fed by social interdiction. There is also a lack of interest among the People in having a public debate on the concepts of judicial independence and immunity, and their use by judges tasked with regulating their peers.
Most importantly, discussion on Organized Judicial Misconduct are hampered by a lack of understating by the People of the differences between administrative and legal judicial powers, and the ways in which judges can use their administrative powers to create Final Judgments that are beyond the scope a legal review or appeal of those judgments.
The latter issue, reliance on appeal of a legal judgment for protection of the People’s Rights, is extraordinarily important in adjudicating parent-child relationships, which occurs every day in our Nation’s Family Courts. Why? Because the issues are not factually or legally based, but emotional and personal judgments that should not be made by government, much less by government aided by privately-paid appointed government-sponsored agents: lawyers, court appointed psychologists and legal representative as “attorneys” of infants and minor children. There is no other part of American justice that is nearly as controversial and contentious than when government dictates parental rights among two normal parents. This is what RightABigWrong.Org’s EVA Project is focused on exclusively.
It is the hope of our EVA Project that our examination of how Organized Judicial Misconduct is allowed under New York State’s Administration of justice in custody cases in its Family Courts can serve as a beacon to local communities throughout the Nation. All communities are dealing with harm done to children by divorce. Family Court judges must not be allowed to make our children’s lives more difficult.
Our organization believes that, like the great U.S. Supreme Court Justice Louis D. Brandeis said, “Publicity is justly commended as a remedy for social and industrial diseases. Sunlight is said to be the best of disinfectants; electric light the most efficient policeman…The Most important political office is that of the private citizen.” Thus, It is up to the Office of the People, to protect our parental rights.
Our objective is to educate Americans on how to identify issues in this their own communities and how to protect their rights. EVA has assembled a complete body of information showing exactly how Family Court judges and judicial systems as a whole work together, and how law is actually “administered” in communities all over America by judicial government officials outside of the our courtrooms.
The issues explored by our EVA Project impacts American lives on a daily basis. Ask yourselves what greater right do American’s possess than your right to justice in the protection of the privacy in your homes and your family or the preservation of your right to educate cultivate, love, honor and protect your children and their freedom.
EVA focuses on one legal issue in one set of limited jurisdiction county courts with strictly limited powers. These courts exist all over the country. They are not a State’s Constitutional courts and they are not courts with equity powers. They are “inferior” courts created by state legislatures to administer a specific type of case. EVA focuses on Family Court and on its treatment of custody cases. On litigation after a divorce. Where one parent seeks to enforce their parental rights under a Judgment of Divorce issued by the superior court of their state.
This is exactly EVA’s purpose. What is this government system about, why it is this way, and why should America care? The answer is simple; because the real and only victims of this system, which allows Organized Judicial Misconduct, are our children.
EVA focuses on investigating, studying and reporting upon the elements of New York State and its Unified Court System as they affect the New York County Family Court (“NYCFC”). The NYCFC is administered by the Unified Court System’s Office of Court Administration and the NYCFC determinations are reviewable by the State’s Appellate Division for the First Department.
